Overview: Section 4 of S.L. 2026-11 (Senate Bill 401) repeals G.S. 143-215.6E, originally enacted in 1997, which directed the Environmental Management Commission (EMC) to develop a Violation Points System applicable to permits for animal waste management systems for swine farms. The Violation Points System was never developed.
The EMC has found that a Violation Points System that does not assess penalties based on fact‑specific assessment factors set forth in G.S. 143‑215.6A and G.S. 143B‑282.1(b) would violate those statutes.
This section became effective June 22, 2026.
