S401 - NC Farm Act of 2025-2026. (SL 2026-11)

Overview: Section 17 of S.L. 2026-11 (Senate Bill 401) provides that the production, processing, storage, use, and sale of compost for agricultural, residential, or commercial purposes by a permitted Small or Large Type 1, Type 2, or Type 3 composting facility, defined by the Environmental Management Commission rules, is "agriculture" for purposes of the Building Code and county zoning exemptions.
This section of the act became effective June 22, 2026.
