S449 - Continuing Budget Operations Part IV. (SL 2025-97)

Overview: Section 5.7 of S.L. 2025-97 (Senate Bill 449) provides that the State Bureau of Investigation (SBI) may contract with any third-party vendor approved by the Director of the SBI for any of the following:

• Fingerprinting.
• Conducting any criminal record check the SBI is authorized to provide by law.
• Fingerprinting and conducting any criminal record check the SBI is authorized to provide by law.

Such third-party vendors may charge a fee for each service provided. Any legal requirements that would apply to the SBI pertaining to the collection of fingerprints or other information collected for a criminal record check apply would apply to third-party vendors used by the SBI.   

This section became effective July 1, 2025, and applies to criminal record checks requested on or after that date.
