Overview: Part VII of S.L. 2025-67 (House Bill 23) requires the Building Code Council to amend the North Carolina State Building Code (Code), and those enforcing the Code prior to the amendment, to include railroad rights-of-way as part of the term “public ways” for open space clearance determinations to allow for an unlimited area building classification for certain existing buildings which also meet specified parcel and building criteria.

This Part became effective July 7, 2025, and expires upon the adoption of permanent rules.
