Overview: S.L. 2025-24 (Senate Bill 344) requires the Department of Health and Human Services to amend its rules and policies for determining eligibility for the Medicaid program and the State-County Special Assistance program so that a disabled individual aged 65 years or older may transfer funds into a pooled special needs trust without incurring an eligibility penalty period when the transfer is made for fair market value.

This act became effective June 26, 2025.
