S257 - 2026 Appropriations Act. (SL 2026-41)

Overview: Section 8A.12 of S.L. 2026-41 (Senate Bill 257), as amended by Section 2.8 of S.L. 2026-42 (House Bill 56) and Section 3.22 of S.L. 2026-61 (House Bill 268), requires nonpublic schools that accept students receiving opportunity scholarship grants to annually certify compliance with the testing requirements for the Opportunity Scholarship Grant Program instead of annually submitting test performance data to the State Education Assistance Authority (SEAA).  Individual test data is still subject to collection by SEAA and the nonpublic schools must retain records of test administration for a period of four years.

This section further directs SEAA to select at least 4% of nonpublic schools accepting students receiving opportunity scholarship grants to verify compliance with the required testing administration each year.  Test performance data collected by SEAA is not considered a public record.

This section became effective July 1, 2026, and applies beginning with the 2026-2027 school year.
