Overview: Section 8A.16 of S.L. 2026-41 (Senate Bill 257) allows the parents of a student receiving a Personal Education Student Account for Children with Disabilities to use scholarship funds for education-related support services provided by a one-to-one classroom aide who holds at least a high school diploma or its equivalent. To use scholarship funds for the services of a one-to-one classroom aide, the scholarship recipient's nonpublic school must submit documentation to the State Education Assistance Authority describing the education-related support services needed each semester.
A parent cannot use scholarship funds for a one-to-one classroom aide who is (i) an immediate relative of the student or (ii) an employee or independent contractor of the student’s nonpublic school.
This section became effective July 7, 2026, and applies beginning with the 2026-2027 school year.
