Overview: Section 7.56 of S.L. 2026-41 (Senate Bill 257) requires the Department of Public Instruction (DPI) to provide funds to charter schools that did not receive the additional pro rata allocation for children with disabilities who attended the charter school during the 2025-2026 school year as required by law. By October 1, 2026, DPI must develop and publish a process to determine the amount owed to each charter school. Charter schools must be given at least 30 days to submit any required information.

By January 15, 2027, DPI must report to the Joint Legislative Education Oversight Committee and the Fiscal Research Division on the following:

  • The process used to identify the charter schools and number of students that did not receive additional funding for children with disabilities during the 2025‑2026 school year.
  • Each school that received additional funds pursuant to this section and the amount each school received.
  • A list of schools that did not respond to DPI's request for information to verify student enrollment.
  • Any changes made to the process to determine the number of children attending charter schools that are children with disabilities for subsequent school years.
  • Any suggested legislative changes that would improve the process of allocating funds for children with disabilities.

This section became effective June 30, 2026.
