Overview: Section 12.16 of S.L. 2026-41 (Senate Bill 257) expands the Department of Environmental Quality's (DEQ) express permit and certification review program to include underground storage tank (UST) installation and replacement certifications pursuant to DEQ's UST Program and sets the maximum fee for UST installation and replacement express certifications at four thousand dollars ($4,000). UST permittees are also required to have received certification for all USTs installed or replaced at the facility, as well as pay the express review fee, as applicable, before being able to receive an operating permit from DEQ.
This section became effective July 1, 2026.
