Overview: Section 12.14 of S.L. 2026-41 (Senate Bill 257) expands the allowable uses of funds from the Dam Safety Emergency Fund, administered by the Department of Environmental Quality (DEQ), to defray certain dam safety costs, to include the provision of technical assistance to dam owners or operators with downstream inundation mapping requirements for intermediate or high hazard dams. This section would also exempt the provision of these downstream inundation mapping services by DEQ from the Umstead Act, which generally prohibits the State from offering goods or services in competition with private actors.
This section became effective July 1, 2026.
