A BILL TO BE ENTITLED

AN ACT to provide that regular municipal elections for certain municipalities in greene county and the election of members of the maury sanitary land district board shall be held in even‑numbered years.

The General Assembly of North Carolina enacts:

 

PART I. CERTAIN MUNICIPALITIES IN GREENE COUNTY

SECTION 1.1.(a)  Section 3.6 of the Charter of the Town of Hookerton, being Chapter 253 of the 1985 Session Laws, reads as rewritten:

"Sec. 3.6. Elections. Elections in the Town of Hookerton shall be conducted in accordance with Subchapter IX of Chapter 163 of the General Statutes, and the results determined by the nonpartisan plurality method in accordance with G.S. 163‑292.

A Mayor shall be elected in 1985 and biennially thereafter 2024, and biennially thereafter, for a two‑year term. Two Commissioners shall be elected in 1985 and quadrennially thereafter 2026, and quadrennially thereafter, for four‑year terms, and two Commissioners shall be elected in 1987 and quadrennially thereafter 2024, and quadrennially thereafter, for four‑year terms."

SECTION 1.1.(b)  The Mayor elected to the Town of Hookerton in 2021 shall continue to serve until 2024. The two Commissioners elected to the Town of Hookerton Board of Commissioners in 2021 shall continue to serve until 2026. No municipal elections shall be conducted in the Town of Hookerton in 2023. The two Commissioners whose terms expire in 2023 are extended until 2024. Regular municipal elections shall be conducted in the Town of Hookerton in 2024.

SECTION 1.2.(a)  Section 5 of the Charter of the Town of Walstonburg, being Chapter 45 of the Private Laws of 1913, reads as rewritten:

"Sec. 5.      That an election shall be held in said town on Tuesday next after the first Monday of May, in the year of our Lord one thousand nine hundred and thirteen, and biennially thereafter, for the election of a mayor and commissioners of said town, under the rules and regulations prescribed for said town elections in chapter seventy-three of the Revisal of one thousand nine hundred and five.In 2024, and biennially thereafter, regular municipal elections shall be held in the Town on the Tuesday after the first Monday in November of even‑numbered years in accordance with the uniform municipal election laws of North Carolina. The Town shall elect a mayor and five commissioners who shall each serve a two‑year term."

SECTION 1.2.(b)  No municipal elections shall be conducted in the Town of Walstonburg in 2023. The Mayor and five Commissioners whose terms expire in 2023 are extended until 2024. Regular municipal elections shall be conducted in the Town of Walstonburg in 2024.

 

PART II. MAURY SANITARY LAND DISTRICT

SECTION 2.1.  G.S. 163‑279(b) reads as rewritten:

"(b)      Officers of sanitary districts elected in 1970 shall hold office until the first Monday in December, 1973, notwithstanding G.S. 130‑126. Beginning in 1973, sanitary district elections shall be held at the times provided in this section or in G.S. 130A‑50(b1).G.S. 130A‑50(b1) or (f)."

SECTION 2.2.  G.S. 130A‑50 is amended by adding a new subsection to read:

"(f)       Notwithstanding any provision to the contrary in this section, sanitary district elections shall be held on the same date as general elections in even‑numbered years under G.S. 163‑1."

SECTION 2.3.  This Part applies to the Maury Sanitary Land District only. The terms of office of those Sanitary Land District Board members whose terms expire in 2023 are extended until their successors are elected and qualified in 2024. The terms of office of those Sanitary Land District Board members whose terms expire in 2025 are extended until their successors are elected and qualified in 2026.

 

PART III. EFFECTIVE DATE

SECTION 3.1.  This act is effective when it becomes law and applies to elections held on or after that date.
