AN ACT to modify the membership requirements of the tourism development authority for the town of burgaw AND TO ALLOW THE TOWN OF SURF CITY TO USE PROCEEDS FROM ON‑STREET PARKING IN THE SAME MANNER IN WHICH PROCEEDS FROM OFF‑STREET PARKING FACILITIES ARE USED.

 

The General Assembly of North Carolina enacts:

 

SECTION 1.  Section 2(a) of S.L. 2006‑167, as amended by Section 1 of S.L. 2013‑38, reads as rewritten:

"SECTION 2.  Tourism Development Authority. – (a)  Appointment and Membership. – When the Board of Commissioners adopts a resolution levying a room occupancy tax under this act, it shall also adopt a resolution creating the Burgaw Tourism Development Authority, which shall be a public authority under the Local Government Budget and Fiscal Control Act. The resolution shall provide for the membership of the Authority, including the members' terms of office, and for the filling of vacancies on the Authority. At least one‑third of the members shall be individuals who are The minimum number of members who are individuals affiliated with businesses that collect the tax in the town and at is one if the membership of the Authority is five members or less and is at least one‑third of the members otherwise. At least one‑half of the members shall be individuals who are currently active in the promotion of travel and tourism in the town. The Board of Commissioners shall designate one member of the Authority as chair and shall determine the compensation, if any, to be paid to members of the Authority.

The Authority shall meet at the call of the chair and shall adopt rules of procedure to govern its meetings. The Finance Officer for the Town of Burgaw shall be the ex officio finance officer of the Authority."

SECTION 2.(a)  Notwithstanding the provisions of G.S. 160A‑301(a), a town may use the proceeds from parking meters on public streets in the same manner in which proceeds from off‑street parking facilities are permitted under G.S. 160A‑301(b).

SECTION 2.(b)  This section applies to the Town of Surf City only.

SECTION 3.  This act is effective when it becomes law.
