AN ACT to Appropriate funds for the Agricultural Sciences Center.

 

The General Assembly of North Carolina enacts:

 

SECTION 1.(a)  Notwithstanding G.S. 143C‑4‑9, one hundred fifteen thousand two hundred twenty dollars ($115,220) of recurring funds appropriated to the Pay Plan Reserve for the 2020‑2021 fiscal year is reallocated and appropriated to the Department of Agriculture and Consumer Services, Food and Drug Division (Budget Code: 13700; Fund Code: 1100), for a full‑time manager position at the Department's Agricultural Sciences Center.

SECTION 1.(b)  Notwithstanding G.S. 143‑215.73F and no later than August 15, 2020, the Department of Environmental Quality shall transfer the sum of three million seven hundred eighty‑three thousand nine hundred twelve dollars ($3,783,912) in nonrecurring funds from the cash balance in the Shallow Draft Navigation Channel Dredging and Aquatic Weed Fund (Budget Code: 24300; Fund Code: 2182) to the Department of Agriculture and Consumer Services, Food and Drug Division (Budget Code: 13700; Fund Code: 1100). The funds transferred in this subsection are appropriated for the 2020‑2021 fiscal year and shall be used for equipment, moving costs, and other nonrecurring expenses associated with the opening of the Department's Agricultural Sciences Center.

SECTION 1.(c)  Notwithstanding G.S. 106‑744 and no later than August 15, 2020, the Department of Agriculture and Consumer Services shall transfer the sum of one million two hundred seventeen thousand eighty‑eight dollars ($1,217,088) in nonrecurring funds from the cash balance in the Agricultural Development and Farmland Preservation Trust Fund (Budget Code: 63701) to the Department's Food and Drug Division (Budget Code: 13700; Fund Code: 1100). The funds transferred in this subsection are appropriated for the 2020‑2021 fiscal year and shall be used for equipment, moving costs, and other nonrecurring expenses associated with the opening of the Department's Agricultural Sciences Center.

SECTION 1.(d)  Notwithstanding G.S. 143B‑437.020 and no later than August 15, 2020, the Department of Commerce shall transfer the sum of five million dollars ($5,000,000) in nonrecurring funds from the cash balance in the Expanded Gas Products Service to Agriculture Fund (Budget Code: 24609; Fund Code: 2539) to the Department of Agriculture and Consumer Services' Food and Drug Division (Budget Code: 13700; Fund Code: 1100). The funds transferred in this subsection are appropriated for the 2020‑2021 fiscal year and shall be used for equipment, moving costs, and other nonrecurring expenses associated with the opening of the Department's Agricultural Sciences Center.

SECTION 2.  The provisions of the State Budget Act, Chapter 143C of the General Statutes, are reenacted and shall remain in full force and effect and are incorporated in this act by reference.

SECTION 3.  Except where expressly repealed or amended by this act, the provisions of any other legislation enacted during the 2019 Regular Session of the General Assembly expressly appropriating funds to an agency, a department, or an institution covered under this act shall remain in effect.

SECTION 4.  This act becomes effective July 1, 2020.
